Previously viewed as a department solely focused on expenses, legal teams have undergone a significant shift. What are the key factors that have propelled legal teams from a cost centre to a strategic partner within organisations?

Not only they expect Legal GCs to manage litigation and drive the deals, but the expectation has grown manifold, they want us to be present in every step in the game (as a trusted business partner), help them in decision making. We all know how the regulatory and legal matters have serious bearing on business decisions.! Moreover, in the global business environment these matters are only becoming complex with multijurisdictional laws. A well thought through decision proves to be less disruptive for business and helps sustain in long run.

 

Can you share a specific instance where your legal expertise significantly influenced a crucial business decision, and what was the outcome of that decision for the company?

Difficult, from a confidentiality standpoint. Generally legal decisions have a profound impact but realisation kicks in later when a given situation demands reopening and reviewing the negotiated terms – what decision is made gets tested at that time. More straightforward and balanced an agreement is negotiated, less are the chances of it being reopened or disputed. Even in cases when they are disputed, if there is clarity in drafting and is balanced then enforceability becomes easier.  Getting an advantage over the other may momentarily look great – very appealing to the management – one would score goodie points, but I believe it’s not healthy in the long run. That said, my practice has always been to have a balanced – well thought through approach.

 

Throughout your career, you have undoubtedly interacted with numerous influential individuals. Can you highlight a particularly memorable or impactful interaction that has shaped your approach to your role as a general counsel?

During my journey, many individuals have inspired and influenced me, it would not be right to name one or two. Integrity, commitment, perseverance and handwork are the traits that have inspired me in an individual. Particularly, individuals who stand up to what they have said and own up the responsibility when matters have gone the other way are traits that I look up to.

 

With the increasing complexity of regulations and compliance requirements, how do you ensure that your legal team stays ahead of the curve and effectively manages the legal risks for your organisation?

Legal teams are very motivated and are savvy with new age technologies and tools. They have a strong network and are always ready to learn and adapt new technology to stay ahead in the curve. I don’t see this as an issue as long as the organisation is investing in them and in new technologies from time to time.
