CMS INDUSLAW has successfully represented the Bombay Group of the Vadilal family in a significant cross-border brand rights dispute, securing important victories both in India and in related proceedings in the United States. 

CMS INDUSLAW secured interim protection from the Bombay High Court preserving the Bombay Group’s continued use of the iconic “Vadilal” brand pending arbitration. The order represents a significant milestone in Private Client disputes concerning the interpretation of longstanding family arrangements governing business rights within the Vadilal group. 

CMS INDUSLAW Team has advised and represented the Bombay Group since the inception of the dispute, developing and implementing the overarching litigation and arbitration strategy and leading the legal teams across multiple jurisdictions. 

Significantly, prior to obtaining relief before the Bombay High Court, the Bombay Group had successfully resisted attempts by the Ahmedabad Group to restrict its rights through proceedings initiated in the United States. CMS INDUSLAW also guided the client in relation to those proceedings, contributing to the successful defence of the Bombay Group’s longstanding rights and helping preserve its position in a dispute with substantial cross-border implications. 

The combined success in both the United States and India underscores the strength of the Bombay Group’s case and ensures the continued protection of its rights under the family settlement framework while the parties pursue resolution of their disputes through arbitration.
