Examples :

In 2012, two girls were arrested in Mumbai for posting a comment on Facebook criticizing the shutdown of the city after the death of a political leader. The comment was deemed to be offensive, and the girls were arrested for defamation. While the charges were later dropped, it shows how social media defamation can have severe consequences.

Another example is the case of businessman Vijay Mallya, who was defamed on social media by his creditors, employees, and the public. The defamation led to a decline in his reputation and business, and he was eventually declared a fugitive economic offender by the Indian government.

 

Legal aspects : In India, defamation is a criminal offense, and a person or business can be sued for defamation under the Indian Penal Code (IPC). According to Section 499 of the IPC, defamation is an offense punishable with imprisonment for a term that may extend to two years, or with fine, or with both.It’s important to note that under Section 79 of the Information Technology (IT) Act, 2000, social media platforms are not held liable for the content posted by their users. However, the platforms must remove any defamatory content upon receiving a court order or a request from the victim of the defamation.
